Equipment Rental Agreement
This Rental Agreement (this “Agreement”) is entered into by and between Iowa CPR, LLC (“Iowa CPR”) and the individual or business paying for the rental through iowacpr.com (“Customer”). 

WHEREAS, Iowa CPR desires to rent out certain equipment described below for the purpose of allowing Customers to complete online CPR and/or First Aid certification.

NOW, THEREFORE, the parties enter into this Agreement upon the following terms and conditions:

1. Equipment Leased

a) The Equipment. Subject to the terms and conditions set forth below, Iowa CPR leases to the Customer and Customer agrees to maintain the following described equipment (the “Equipment”):
1 Adult CPR mannequin
1 Infant CPR mannequin
1 AED Trainer
1 Epinephrine Auto-Injector Trainer (not included with BLS)
1 Adult CPR mask (BLS Only)
1 Infant CPR mask (BLS Only)
The Equipment does not include the following disposable materials which need not be returned:
CPR face shield, gauze pads, gauze roll and gloves. 

b) Delivery of the Equipment. Iowa CPR shall deliver the Equipment to the Customer at the address used to register for the course. The Equipment will be left at the Customer’s doorstep the evening before or the morning of the online training session.  

c) Return of the Equipment. Upon completion of the course, Customer shall pack up and return the Equipment to the same site that Iowa CPR first delivered the Equipment by 8am the morning after the online course. This site would ideally be a hidden location that can’t be seen from the street and is protected from the elements. If Iowa CPR is unable to locate or retrieve the Equipment, Iowa CPR will try to contact the Customer at the location of delivery. If Iowa CPR is unable to collect the Equipment by 8am the morning after the online course, the customer will be charged a fee of $25.00 per day that Iowa CPR is unable to retrieve the package (the fee will be charged to the payment method used to register for the course). If Iowa CPR is unable to collect the package for 7 consecutive days, the Customer’s payment method will be charged for the full cost of the Equipment up to $500.00. 

2. Maintenance of Equipment.  The Customer shall keep the Equipment in good and clean operating condition and shall advise Iowa CPR of any issues or injury to the Equipment immediately. Iowa CPR will keep photographic record of the Equipment prior to and after each rental and any damage to the Equipment will be charged to the Customer’s form of payment. 

3.  Term. This Agreement shall be effective for a period of 1 day.  It shall commence on the date of delivery of the Equipment and shall terminate once the Equipment is retrieved in good condition or after 7 days of non-return, whichever is sooner. 

4.  Force Majeure.  In the event that either party is unable to perform any of its obligations under this Agreement or to enjoy any of its benefits because of natural disaster or decrees of governmental bodies not the fault of the affected party (hereinafter referred to as a “Force Majeure Event”), the party who has been so affected shall immediately give notice to the other party and shall do everything possible to resume performance.  

5.  Miscellaneous.  If any provision of this Agreement is held to be invalid or unenforceable, such provision will be struck and the remaining provisions will remain in full force and effect.

By clicking accept and continuing to payment, the Customer is agreeing to be held liable for any damages to the Equipment or any fees in relation to Iowa CPR’s inability to retrieve the Equipment after course completion as mentioned in Section 1(c) above. This Agreement is legally binding upon payment of the online course.
